Legal Tidbits for Artists

You believe in your creative work (and we do too!) but how well-versed are you in legal lingo? A recent needs assessment found that more than 90% of artists and arts organizations found access to legal resources and support insufficient. We’ve partnered with the Manitoba Legal Clinic for the Arts to help fill you in on your rights as an artist and how you can apply them to your arts practice.

Intellectual Property (IP) is a legal term that describes an area of law that includes a set of legal rights and protections (including copyright) that can be owned in certain types of creative works. It’s important for artists as it helps to protect creative works and ensures creators can benefit from their endeavours!

Copyright is the exclusive legal right to use, produce, reproduce, publish, or perform an original literary, artistic, musical or dramatic work. You have full control over who can use your work, how it is used, and on what terms. Copyright is a type of IP, along with trademarks, patents, industrial designs, and trade secrets.

^ The information above was created by students from the Manitoba Legal Clinic for the Arts, it is not legal advice nor does it create a solicitor-client relationship. The Clinic provides information and services entirely for free. Why? To support artists doing what they do best– creating– which makes the world a better place for everyone! If you need legal assistance, please fill out an intake form at legalclinicforthearts.ca
