Beyond what may first come to mind when we think of creative copyright, Canada has recognized the importance of protecting Traditional Cultural Expressions (TCEs) of Indigenous communities. TCEs- which are also referred to as “expressions of folklore”- include things like traditional designs, songs, dances, and other cultural practices that help form the history and identity of a community. The concept of protecting TCEs goes beyond standard copyright law and often involves a mix of legal, cultural, and community-specific mechanisms.
CARFAC Canada has provided a fantastic resource guide in both English and French about Indigenous intellectual and cultural property rights in the visual arts. Hit the link to learn more!
